Ring of Death, is My Xbox 360 out of Warranty?

This morning I have found my xbox 360 with the dreaded red ring of death and it needs to be sent back. It is out of warranty as i brought it in April 2006, so its is no longer covered by the three year extended warranty. It has however been fixed before last year for the same problem, does anyone know if I have a rightful claim to a free repair.
