Don't Put Any Kinect Discs in Your Xbox Just Yet

If you've managed to score an early copy of any Kinect launch game, don't put it in your 360 console just yet: it will update your 360 to the new Kinect-enabled dashboard, but you won't be able to connect to Live without downloading another update. The problem with that is the newest update doesn't exist on the servers yet – for obvious reasons – so you'll be stuck in a never-ending loop of misery.
If you really must, disconnect your console from Live before you pop that copy of Kinect Sports in your tray. Or of course you could just leave the game in its shrinkwrap and wait for Kinect to come out and bring with it the necessary update and controller to actually play the game. Should be an easy choice.

I can't think of anyone who this would affect though. Who would have a copy of an unreleased game and not the controller?

The thing is that some stores already have Kinect in stock but are not supposed to sell it early. I went into my local Sears store yesterday and asked the sales person if they would be carrying and selling Kinect. He went to go check on it and not long after he emerged from the stock room with a Kinect in hand. He proceeded to ring it up for me but the computer would not let him sell it. I told him that it is a street-dated item and it shouldn't be sold until it's release date. So, I almost got myself a Kinect early but I wouldn't have been able to do anything with it considering this timed update Microsoft has in place.

It happens though. A few years back Madden got released like a week early in some places and the gamers who thought they were extremely lucky found themselves extremely unlucky with banned accounts. As far as Microsoft was concerned it was pirated copies of the game. I want to say it was around 2005-2006 when the exclusive EA NFL contract took effect but Im not sure on the exact date.
Bottom Line... if you ever do for some reason get something early and you shouldnt.... DONT PUT IT ONLINE and/or DISCONNECT YOUR SYSTEM!
