Suggestion:
They look for the mod, not the type of disc that's used, so yes you can still get banned if your console is modded.

From what I understand, if it is your first offense they will suspend your account for a few days. Then the next time they can ban the 360 you are playing on and your account.
They will bann your xbox but if u modify your xbox with lt2.0 then they won.t bann your xbox360. Secondly they never bann your id
As far as I know, you shouldn't. Don't quote me on this though.
