Should I Return Oblivion to Game?

I bought Oblivion for my xbox 360 four days ago, it was a brand new copy, game of the year edition, not pre-owned. It keeps freezing and sometimes it comes up with the "disc unreadable" message. Will game take it back? I purchased it with store credit. I have the receipt.
