Is It Possible to Play Real Games on a Modded Xbox360 on Xbox Live Without Getting Banned?

For an example, if I play burnt games offline and I played the real ones online

Suggestion:

MS will detect the modification in your 360 and ban you completely if you go online. Real game or not.

: The firmware in which you flash the 360 with is what gets you banned. Also the playing of a game that is a bad rip or if you play games before release will also get you banned. The new firmware, iXtreme LT, is undetectable at the moment but Microsoft will always find ways to detect your firmware. Playing burned games offline won't insure your safety at all if you plan on going back on LIVE. Playing burned games WON'T mess up your 360 in any way so I don't know what that other person is talking about.Mine is flashed with the newest firmware and everything's going fine for now. I say you just do it and if it gets banned later down the road, just sell it and buy another.
: First of all, why bother modding an xbox 360, why don't you just be like everyone else and have a white or black xbox 360.. As with the burnt games if you play them too much they will start to freeze in the middle of gameplay and say "the disc is unreadable" and it will ruin your xbox.

Why go through the trouble.
