Suggestion:
go to xbox.com and register your xbox with them. The repair process in the website has pretty good step-by-step instructions. Just tell them what the problem is and basically walk through the repair. At the end it will tell you how much you have to pay (none if the warranty covers it). That kind of problem though seems like a manufacturing error, so I think you got good chances of a refund, even if the standard one year warranty is up.
PS-don't lie to them. You get screwed if they get the xbox and what you said was not the problem.
